The first action of our Law Firm in Rotterdam is to draft a writ of summon, which has to contain all the key elements of the defense, the conclusions and the evidences. It is very crucial to prepare a complete deed in order to give to the Court a complete overview of the case for a faster decision.
The continuation of the process depends on the complexity of the case and on the juridical issues arising from the concrete situation. According to the Dutch Law we may face different situations during a court trial in Rotterdam:
1. If the defendant does not appear in the process, there will be an automatical default judgement;
2. If the defendant appears he will have a term for his constitution and the judge will set a court hearing for the discussion and/or to reach a settlement agreement. If the settlement is not reached and the Court will consider the case ready for a decision, it will determine a date for the final judgement.
3. The Court in Rotterdam, if the agreement is not reached and there are still some elements to be verified, instead of providing a date for the judgement, may evaluate all the evidences purposed by the parties (witnesses, appointment of an expert for technical issues). Only after the evaluation of the evidences, the Court will provide a date for the final judgement.
